Terms of Service, Privacy Policy & Refund Policy

Last updated: September 1, 2026. Written in plain English so you can actually read it. Questions? Email hello@yesavailable.link.

Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Available!™ platform at yesavailable.link and any related services (collectively, the “Service”) provided by Available!™ (“Available!™”, “we”, “us”, or “our”), currently operated as a sole proprietorship.

1. Acceptance of Terms

By creating an account, verifying a phone number on the Service, reserving an item, listing an item, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy, each incorporated by reference. If you do not agree, do not use the Service.

We may update these Terms from time to time. When we make material changes, we will provide notice by email, SMS, or an in-app banner, and we may require you to re-accept the updated Terms before continuing to use the Service. Non-material changes take effect on the “Last updated” date shown at the top of this page.

2. Eligibility

You must be at least 18 years old, a resident of the United States, and have the legal capacity to enter into a binding contract to use the Service. Sellers who connect a Stripe account must independently meet Stripe’s eligibility requirements, which typically include being 18 or older and passing Stripe’s identity verification.

You may not use the Service if you are barred from receiving services under U.S. law or the laws of any other jurisdiction that applies to you, including if you are on any U.S. government list of prohibited or restricted parties (for example, the OFAC Specially Designated Nationals list).

3. What Available!™ Is (and Isn't)

Available!™ is a technology platform that lets sellers post items they own for local, in-person sale, and lets buyers reserve those items with a phone-verified commitment. Optional card payment is processed by Stripe Connect.

We are not a merchant. We do not own, sell, resell, warehouse, ship, appraise, authenticate, or take possession of any item listed on the Service. All transactions are directly between the buyer and the seller.

We are not a party to your transaction. The legal contract for the sale of any item is formed between the buyer and the seller, not with Available!™ We provide the reservation, messaging, and (optionally) payment-routing tools that facilitate that transaction.

We are not your employer, partner, or agent. Nothing in these Terms creates an employment, partnership, joint-venture, franchise, or agency relationship between you and Available!™

4. Account Registration and Security

To reserve an item or list items for sale, you must verify a valid U.S. mobile phone number via SMS one-time passcode (delivered by our verification provider, Twilio). You are responsible for providing accurate information and for keeping your account information current.

You may hold only one account per person. You may not share your account, transfer it, or let another person reserve or list items using your phone number. You are responsible for all activity that occurs under your account, including anyone who gains access to your verified phone number.

You must notify us immediately at hello@yesavailable.link if you believe your account has been compromised or your phone number has been ported without your authorization.

We may suspend or terminate any account at any time, with or without notice, for any violation of these Terms, for suspected fraudulent or abusive activity, or as we otherwise reasonably determine is necessary to protect the Service or its users.

5. Seller Terms

If you list items on the Service, you represent and warrant that:

  • you own the items you list, or are otherwise legally authorized to sell them;
  • your listings (photos, descriptions, prices, condition, location) are accurate, not misleading, and not deceptive;
  • you will comply with all federal, state, and local laws that apply to your sale, including used-goods sales tax obligations, resale-certificate rules, and any licensing requirements;
  • you will report and remit all income and taxes required by law, and you understand that Stripe may issue you an IRS Form 1099-K if your card-processed sales cross the applicable federal or state reporting threshold;
  • you will honor confirmed reservations in good faith and communicate promptly with buyers.

Prohibited items. You may not list, and we may remove without notice, any of the following:

  • firearms, ammunition, ammunition components, and weapons of any kind (including knives sold as weapons, tasers, and pepper spray where prohibited by law);
  • illegal drugs, drug paraphernalia, prescription medications, controlled substances, and unregulated supplements;
  • stolen goods, goods with removed or altered serial numbers, and goods you do not have clear title to;
  • live animals, animal parts (including ivory), and human remains or bodily fluids;
  • counterfeit or knock-off goods, and items that infringe third-party intellectual property rights;
  • hazardous materials, including asbestos, lead paint, mercury devices, fireworks, flammable liquids in unapproved containers, and any material regulated under DOT or EPA hazmat rules;
  • recalled products (as listed by the CPSC or other regulator), recalled infant and children’s products, and used car seats;
  • food, home-canned goods, unpasteurized dairy, and any perishable item subject to health-department regulation;
  • alcohol, tobacco, e-cigarettes, and cannabis products in any form;
  • items promoting hate, violence, or discrimination against protected classes, and Nazi or similar hate memorabilia;
  • adult sexual content, and items intended for sexual use;
  • medical devices, prescription eyewear, and hearing aids subject to FDA regulation;
  • anything else the sale of which requires a license, permit, or certification you do not hold, or that is otherwise unlawful in your jurisdiction or the buyer’s jurisdiction.

You are solely responsible for your listings, your interactions with buyers, the safety of your pickup location, and the tax treatment of your sales. Available!™ does not pre-moderate listings and does not vouch for the accuracy of any listing.

6. Buyer Terms

If you reserve an item on the Service, you represent and agree that:

  • you are committing in good faith to purchase the reserved item at the listed price, subject to inspection at pickup;
  • you will arrive during the pickup window arranged with the seller, or will notify the seller in advance if you cannot;
  • you accept that repeated no-shows may result in strikes against your phone number, and that after three (3) strikes your phone number may be blocked from reserving items anywhere on the Service;
  • you will not use the Service to harass, defraud, threaten, or discriminate against any seller;
  • you understand that inspecting the item and completing the purchase is your responsibility, and that Available!™ does not guarantee the condition, authenticity, safety, or fitness for purpose of any listed item.

Meeting safely. Meet in daylight, in a public place where possible, bring a friend for higher-value items, and tell someone where you are going. Available!™ is not responsible for the safety of in-person meetups arranged through the Service.

7. Fees

The Service is free to browse, list, and reserve. Fees apply only when a buyer pays by card via Stripe on the Service:

  • Seller platform fee: 5% of the item price, deducted automatically from the seller’s Stripe payout via Stripe’s application-fee mechanism.
  • Buyer service fee: 2% of the item price (no minimum), added to the buyer’s total at checkout.
  • Stripe’s own payment-processing fees (currently approximately 2.9% + $0.30 per transaction) also apply and are deducted by Stripe from the seller’s payout.

There are no Available!™ fees on cash, Venmo, PayPal, or other in-person payments arranged between users. Available!™ is not involved in those payments and does not receive any share of them.

Fees are non-refundable except (a) as expressly set out in the Refund Policy below, (b) where required by applicable law, or (c) at our sole discretion. We may change our fees at any time by posting an updated fee schedule; changes apply prospectively and will not affect transactions already in progress.

8. Payments

Card payments on the Service are processed by Stripe, Inc. and its affiliates through Stripe Connect Express using the direct-charge model. Funds flow from the buyer to the seller’s connected Stripe account. Available!™’s platform fee is collected as a Stripe application fee at the time of charge.

Available!™ does not receive, hold, or control seller funds. All payout timing, hold periods, reserve requirements, and payout methods are governed by Stripe’s agreement with the seller. Chargebacks, refunds initiated outside the Service, and disputes filed with a card network are governed by Stripe’s rules and the card network’s rules.

By using card payments on the Service, both buyers and sellers agree to Stripe’s applicable terms, including the Stripe Connected Account Agreement and Stripe Services Agreement.

9. Reservations and Cancellations

When a buyer reserves an item, Available!™ places a soft hold on that item for a limited time (the “hold window”). If the buyer selects a specific pickup window at reservation, the hold typically expires shortly after that window ends. If no pickup window is selected, a default hold duration applies. During the hold window, the item is reserved for that buyer.

Buy-Now preempt. For sellers who enable card payment, another buyer may complete a Buy-Now card purchase for the same item during an unpaid reservation. In that case, the paying buyer wins the item, the earlier unpaid reservation is automatically cancelled, and no charge is made to the earlier buyer. If the earlier buyer had pre-authorized a card for any reason, any authorization is voided or refunded automatically.

Cancellations. A buyer may cancel an unpaid reservation at any time via the reservation link. A seller may cancel a reservation for cause (for example, the item was already sold offline, or the buyer is not responsive) and should notify the buyer promptly.

No-shows. Buyers who fail to appear at the arranged pickup and do not communicate with the seller may receive a strike on their verified phone number. Three (3) strikes may result in the phone number being blocked from reserving items on the Service.

10. Refunds

Refunds are governed by the Refund Policy below. In summary: Stripe card payments are refundable by the seller from their admin dashboard; buy-now preempts are refunded automatically; and cash, Venmo, or PayPal refunds are handled directly between the buyer and the seller, with no involvement from Available!™

11. Prohibited Conduct

You may not, and may not permit any third party to:

  • use the Service for any unlawful purpose or in violation of any local, state, federal, or international law;
  • post false, misleading, deceptive, or fraudulent listings;
  • use the Service to launder money, evade taxes, or evade sanctions;
  • harass, threaten, defame, stalk, or discriminate against any other user;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • circumvent, disable, or interfere with security or rate-limiting features of the Service;
  • scrape, crawl, harvest, or index the Service or user data by automated means, except as expressly permitted by our robots.txt or by prior written consent;
  • reverse-engineer, decompile, or disassemble any part of the Service, except to the extent that applicable law prohibits such restrictions;
  • upload viruses, malware, or other harmful code;
  • use the Service to send spam, unsolicited commercial messages, or phishing attempts to other users;
  • use another user’s phone number, name, or listing without authorization;
  • interfere with, disrupt, or place unreasonable load on the Service or its infrastructure.

12. User-Generated Content

You retain ownership of the listings, photos, descriptions, and other content you upload to the Service (“Your Content”). By posting Your Content, you grant Available!™ a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt (including for resizing, thumbnailing, and AI-generated description enhancement), and distribute Your Content solely for the purposes of operating, promoting, and improving the Service.

You represent and warrant that you own or otherwise control all rights necessary to grant the license above, and that Your Content does not infringe any third party’s rights, including copyright, trademark, publicity, or privacy rights.

We may remove Your Content at any time, with or without notice, if we believe it violates these Terms, the rights of any third party, or any applicable law.

AI-generated descriptions. When you upload photos of an item, you may request that we generate a suggested description using a third-party generative-AI model (currently Google Gemini, accessed via Vercel AI Gateway). You review and edit any AI-generated description before it is published. You are solely responsible for the final published description.

DMCA / copyright infringement. If you believe that content on the Service infringes your copyright, please send a written notice to our designated agent under the Digital Millennium Copyright Act (17 U.S.C. § 512):

Designated DMCA Agent: Myles Weissleder
Email: hello@yesavailable.link (subject line: DMCA Takedown)
Location: Novato, California, USA
Formal designation with the U.S. Copyright Office is pending; a mailing address for physical notices will be published here once registration completes. Email notices are honored and acted on in the meantime.

Your DMCA notice must include: (i) a physical or electronic signature; (ii) identification of the copyrighted work; (iii) identification of the allegedly infringing material and its location on the Service; (iv) your contact information; (v) a statement of good-faith belief; and (vi) a statement, under penalty of perjury, that the information is accurate and you are authorized to act. We may remove allegedly infringing content and terminate repeat infringers.

13. Intellectual Property

The Available!™ name, logo, and the “Available!™” wordmark, together with all software, design, text, graphics, and other materials that make up the Service (excluding Your Content), are owned by Available!™ or its licensors and are protected by U.S. and international intellectual-property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. Any other use requires our prior written permission.

14. Third-Party Services

The Service relies on third-party providers, including Stripe (payments and Stripe Connect), Twilio (SMS delivery and phone-number verification), Resend (transactional email), Vercel (hosting and Blob storage), Neon (Postgres database), Google (via Vercel AI Gateway, for generative-AI item descriptions), and Sentry (error monitoring). Your use of the Service is also subject to the terms and privacy policies of these providers where they apply.

Available!™ is not responsible for outages, errors, data loss, or security incidents caused by third-party providers, except to the extent required by applicable law.

15. Termination

You may stop using the Service at any time. You may request that we delete your account and associated data by emailing hello@yesavailable.link; we will process the request in accordance with the retention rules described in the Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms, for suspected fraudulent or unlawful activity, or where continued access poses risk to the Service or its users. Sections of these Terms that by their nature should survive termination (including intellectual-property terms, disclaimers, limitations of liability, indemnification, and dispute-resolution provisions) will survive.

16. Disclaimers

The Service is provided on an “as is” and “as available” basis, without warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, Available!™ disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that any listing is accurate, complete, or lawful; that any item is authentic, safe, of merchantable quality, or fit for any particular purpose; that any seller or buyer is who they claim to be beyond phone-number verification; or that any in-person meeting arranged through the Service will be safe. You use the Service at your own risk.

17. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Available!™, its owners, officers, employees, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or related to the Service or these Terms is limited to the greater of (a) the total fees you have paid to Available!™ in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud to the extent such limitation is prohibited by applicable law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Available!™ and its owner, officers, employees, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) any listing, item, or transaction you post, complete, or attempt on the Service; (c) your breach of these Terms; (d) your violation of any law or the rights of any third party; or (e) any content you submit to the Service.

19. Governing Law, Arbitration, and Class-Action Waiver

Governing law. These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of California, excluding its conflict-of-laws rules.

Informal dispute resolution. Before filing a claim, you agree to first try to resolve the dispute informally by emailing hello@yesavailable.link with a description of the dispute, your contact information, and the relief you seek. We will attempt to resolve the dispute informally within thirty (30) days.

Binding arbitration. If we cannot resolve the dispute informally, you and Available!™ agree that any dispute, claim, or controversy arising out of or related to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court, except that: (i) either party may bring an individual action in small-claims court for disputes that qualify; and (ii) either party may seek injunctive relief in court to protect intellectual-property rights. The arbitration will take place in Marin County, California, or by video or telephone at your election. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and Available!™ agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial.

30-day opt-out. You may opt out of this arbitration and class-action waiver by sending written notice to hello@yesavailable.link within thirty (30) days of first accepting these Terms, stating that you opt out. Opting out does not affect the other provisions of these Terms.

Venue for non-arbitrable disputes. For any dispute not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Marin County, California.

Governing law. These Terms are governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16, and, to the extent not preempted, the laws of the State of California without regard to conflict-of-law principles.

20. Changes to These Terms

We may update these Terms at any time. When we make changes, we will update the “Last updated” date at the top of this page. For material changes, we will additionally provide notice by email, SMS, or in-app banner, and we may require you to re-accept the updated Terms before continuing to use the Service. Your continued use of the Service after an update constitutes your acceptance of the updated Terms.

21. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Available!™ regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms, in whole or in part, at any time without notice, including in connection with any merger, acquisition, or sale of assets.

Force majeure. We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, pandemics, or failures of third-party providers or the Internet.

Notices to you. We may provide notices to you by email (to the address you provide), by SMS (to your verified phone number), or by posting a notice within the Service. You consent to receive notices electronically.

Notices to us. Notices to Available!™ should be sent to hello@yesavailable.link.

SMS Messaging & Consent

This section describes our SMS practices and is provided separately for A2P 10DLC campaign-registration purposes.

What we send

All SMS from Available!™ is transactional and tied to an action you initiated on the Service. There are three message types: (1) a one-time verification code when you first verify your phone number; (2) a hold confirmation with a link to your reservation; and (3) pickup-address details after the reservation is confirmed. We do not send marketing or promotional SMS. Ever.

Frequency and rates

SMS frequency varies by your activity. A typical reserve-then-pickup flow generates about 3–5 automated messages: verification code, hold confirmation, pickup details, and any situational notifications (bumped by a paying preempt, refund confirmation, waitlist promotion). If you exchange messages with the counterparty through Available!™’s anonymized relay (buyer to seller or vice versa), each message is a separate SMS. If you reserve multiple items, each reservation generates its own messages. Message and data rates may apply depending on your mobile plan. Available!™ does not charge you to receive SMS.

Opt-in

You opt in by entering your U.S. mobile phone number on an item reservation page (for example yesavailable.link/i/<item-id>), actively checking a consent checkbox, and tapping the submit button. Consent is never pre-checked. Consent to receive SMS is not required to view listings, only to reserve an item or manage a seller account.

Live example of the opt-in disclosure: visible on any live item page, e.g. yesavailable.link/i/c25ed6fa-4de5-471d-8f73-111c1bcc86b3.

Opt-out (STOP) and help (HELP)

Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any SMS from Available!™ to unsubscribe immediately. Reply HELP for support instructions, or email hello@yesavailable.link for support. STOP and HELP handling is provided at the carrier level by Twilio.

Non-sharing of mobile numbers

Your mobile phone number and consent for messaging will not be shared, sold, rented, or transferred to any third party or affiliate for marketing purposes. Numbers are used only to deliver the transactional SMS described above, to verify identity when you sign in, and to prevent bad-actor behavior on the Service.

Privacy Policy

This Privacy Policy describes how Available!™ collects, uses, and shares information about you when you use the Service.

1. Information we collect

We collect only what we need to run the Service:

  • Phone number, verified via SMS one-time passcode through Twilio Verify. Buyer phone numbers are stored in a hashed form for reservation and strike tracking; seller phone numbers are stored in plaintext because sellers need them for account recovery and pickup coordination.
  • Name, as you provide it (typically first name for buyers, full or preferred name for sellers).
  • Email address, optional, used for transactional email (receipts, hold confirmations, sale summaries).
  • Item listings and photos you upload. Photos are stored on Vercel Blob and served from public URLs.
  • Source attribution from the ?src= URL parameter, so sellers can see which channel (Facebook group, Nextdoor, Craigslist, direct link, etc.) referred a buyer.
  • IP address and user-agent, used for rate limiting, fraud prevention, and debugging.
  • Stripe connected-account ID for sellers who have connected Stripe. Stripe collects and stores the underlying business, tax, and banking information directly; we do not receive or store it.
  • Payment metadata returned by Stripe when a buyer pays by card (Stripe charge ID, amount, fee amounts, status). We do not receive or store full card numbers, CVV codes, or bank-account numbers.
  • Session tokens stored as a signed JWT (using the jose library) in an HTTP-only cookie, used to keep you signed in as a seller.
  • Analytics events generated as you use the Service (item view, share, reserve, pay). These are used to give sellers a per-item funnel and to help us improve the product.

2. What we don't collect

We do not collect or store: full credit- or debit-card numbers or CVV codes (Stripe holds these), Social Security numbers, driver’s-license numbers, biometric data, precise geolocation, health or medical data, or credit-history data. We do not use marketing cookies or cross-site tracking pixels.

3. How we use information

We use the information we collect to:

  • provide, operate, and improve the Service;
  • verify your identity, prevent fraud, and protect the Service from abuse;
  • calculate, charge, and remit fees, and route payments through Stripe;
  • send the transactional SMS you opted in to receive (holds, receipts, pickup details);
  • send transactional email (receipts, hold confirmations, sale summaries) via Resend;
  • generate aggregated, de-identified analytics to understand usage and improve the product;
  • respond to your support requests and legal or regulatory inquiries.

4. How we share information

We do not sell your personal information. We share information only with service providers we use to run the Service, and only for the purposes described below:

  • Stripe (Stripe, Inc.) for payment processing and Stripe Connect payout routing.
  • Twilio for SMS delivery and phone-number verification.
  • Resend for transactional email delivery.
  • Vercel for platform hosting, edge networking, and Blob storage of item photos.
  • Neon for our Postgres database.
  • Google (via Vercel AI Gateway) for generative-AI item-description suggestions from photos you upload. Photos submitted for AI description are transmitted to Google Gemini for that purpose only.
  • Sentry for error monitoring and diagnostics.

We may also disclose information: (a) in response to a valid subpoena, court order, or other legal process; (b) to establish, exercise, or defend legal claims; (c) to protect the rights, property, or safety of Available!™, our users, or the public; or (d) in connection with a merger, acquisition, or sale of assets, in which case we will notify users of any material change in how their information is handled.

Mobile phone numbers. As required by our SMS carrier partners, we do not share, sell, rent, or transfer your mobile phone number or SMS-consent information to any third party or affiliate for marketing purposes.

5. Cookies and similar technologies

We use a single first-party HTTP-only cookie to store your signed session token (JWT). We do not use marketing cookies, advertising identifiers, or cross-site tracking pixels. We do not participate in ad networks.

6. Data retention

We retain information for as long as your account is active and as needed to provide the Service:

  • Active account data is retained while your account is active.
  • Deleted-account data is purged from our production database within ninety (90) days of your deletion request, subject to the exceptions below.
  • Payment and tax records maintained by Stripe are retained by Stripe for at least seven (7) years per IRS record-retention rules; those records live in Stripe, not with us.
  • Server logs are retained for approximately thirty (30) days for security and debugging purposes.
  • Fraud and abuse signals (including hashed phone numbers subject to strikes) may be retained longer where necessary to protect the Service and other users.
  • Legal-hold data may be retained where required to comply with legal or regulatory obligations.

7. California residents (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA/CPRA”), gives you certain rights with respect to your personal information:

  • Right to know what personal information we have collected about you, the categories of sources, the business or commercial purpose, and the categories of third parties with whom we shared it.
  • Right to delete personal information we have collected from you, subject to certain exceptions.
  • Right to correct inaccurate personal information.
  • Right to opt out of sale or sharing of your personal information. Available!™ does not sell personal information and does not share it for cross-context behavioral advertising, so there is nothing to opt out of; we make this affirmative disclosure for transparency.
  • Right to non-discrimination for exercising any of your CCPA/CPRA rights.
  • Right to designate an authorized agent to make requests on your behalf.

To exercise any of these rights, email hello@yesavailable.link with the subject line “CCPA Request” and a description of the request. We will verify your identity by reference to your verified phone number or connected email address before fulfilling the request, and we will respond within the timelines required by law.

Scope note. Available!™ is a small individually-operated service and does not currently meet the CCPA/CPRA thresholds that trigger formal “Do Not Sell or Share My Personal Information” disclosures (annual gross revenue over $25M, personal information of 100,000+ California residents, or 50%+ of revenue derived from selling personal information). We provide the rights above on a voluntary basis. If Available!™ grows past those thresholds, this section will be updated with the additional formal disclosures the law requires.

8. International users

The Service is offered only in the United States and is intended for U.S.-based users. We do not currently offer the Service to users outside the United States. If you are accessing the Service from outside the United States, please do not use the Service. Information collected through the Service is stored and processed in the United States.

9. Children

The Service is intended for users 18 years of age or older. We do not knowingly collect personal information from children under 13, and we do not knowingly allow anyone under 18 to create an account or transact on the Service. If you believe a minor has provided us with personal information, please email hello@yesavailable.link and we will promptly delete the account and associated data.

10. Security

We take reasonable technical and organizational measures to protect information on the Service, including HTTPS everywhere, HTTP-only signed session cookies, rate limiting on sensitive endpoints, and continuous error monitoring via Sentry. Payment card data is handled by Stripe, a PCI-DSS Level 1 certified provider; we do not touch card numbers.

No system is perfectly secure. In the event of a data breach affecting your personal information, we will notify you and regulators as required by applicable law.

11. Changes to this Policy

We may update this Privacy Policy from time to time. When we make material changes, we will provide notice by email, SMS, or in-app banner. The “Last updated” date at the top of this page indicates when this policy was last revised.

Refund Policy

Because Available!™ is a platform, not a merchant, the refund mechanics depend on how the buyer paid.

1. Card payments via Stripe

When a buyer pays by card on the Service, the seller can issue a full or partial refund from their admin dashboard at any time up to 180 days after the payment. Refunds are returned to the original card by Stripe.

When the seller issues a full refund of the item price, the buyer service fee (2% of the item price) is also refunded. When the seller issues a partial refund, the buyer service fee is not automatically refunded, but the seller may request a service-fee refund by emailing hello@yesavailable.link.

Stripe’s own processing fees (approximately 2.9% + $0.30 per transaction) are generally not returned by Stripe on refund, per Stripe’s policy. Available!™ does not reimburse Stripe processing fees.

2. Automatic refunds on Buy-Now preempt

If another buyer completes a Buy-Now card purchase for the same item while your unpaid reservation is still active, your reservation is automatically cancelled and, if any card authorization was placed, it is automatically voided or refunded. No action is required on your part. If you believe a preempt refund did not arrive, contact hello@yesavailable.link.

3. Cash, Venmo, PayPal, and other in-person payments

For payments arranged in person (cash, Venmo, PayPal, Zelle, or any other channel outside of Stripe on the Service), Available!™ has no view into the transaction and cannot reverse it. Refunds for these payments are handled directly between the buyer and the seller. Please contact the other party first. If you cannot reach agreement and you paid via a platform (Venmo, PayPal) that has its own dispute mechanism, you may pursue resolution there.

4. Chargebacks

If you paid by card and believe you are entitled to a refund, please contact the seller and then Available!™ (hello@yesavailable.link) before opening a chargeback with your card issuer. Chargebacks are costly and often unnecessary. We will work with you and the seller to resolve legitimate refund requests quickly. Unauthorized or bad-faith chargebacks may result in suspension of your account and blocking of your phone number from the Service.

5. Fees on refunded transactions

The buyer service fee (2% of the item price) is refundable when a full refund is issued. The seller platform fee (5%) is reversed automatically when a full refund is issued through Stripe. Partial refunds do not automatically reverse the platform fee or service fee; contact us if a proportional adjustment is appropriate.

6. Time limits

Stripe supports refunds to the original card up to 180 days after the original charge. After 180 days, refunds via the original card are not possible and any resolution must be handled directly between buyer and seller.
